Terms of Use

1. Eligibility and accounts

You must be at least 16 years old to use Kivocard. You must provide accurate account information, keep your credentials secure, and promptly notify us if you believe your account has been compromised. You are responsible for activity performed through your account.

2. The service and AI results

Kivocard helps you create, edit, organize, and study flashcards. AI-generated flashcards, extracted text, source references, and AI Quiz choices can contain mistakes or omit context. They are study aids, not professional, legal, medical, financial, or academic advice. You are responsible for reviewing generated content before relying on it.

3. Your content

You retain ownership of material you upload and content you create. You grant Kivocard a limited, non-exclusive license to host, copy, convert, process, and display that content only as needed to operate, secure, and improve the service for you. You confirm that you have the rights needed to submit the content.

4. Acceptable use

You may not use Kivocard to violate law or another person’s rights; upload malware or unlawful content; probe, disrupt, overload, reverse engineer, or bypass the service; evade plan limits; share access credentials for abuse; or use automated access without permission. We may restrict activity that threatens the service or other users.

5. Plans and usage allowances

The Free plan includes 20 AI-generated flashcards for the lifetime of the account, unlimited manual cards, Play, and Standard Quiz, plus reuse of valid saved AI Quiz choices. Pro currently includes 500 AI-generated flashcards and 500 newly generated AI Quiz card sets per subscription month, CSV export, and a choice of Monthly or Yearly billing.

Monthly AI allowances reset each subscription month, including for Yearly subscriptions. Unused allowances do not roll over. Successfully saved AI Quiz choices can be reused without another generation charge unless the underlying question or answer is edited and new choices are required.

6. Billing, renewal, cancellation, and refunds

Paid plans renew automatically at the displayed Monthly or Yearly price until canceled. Taxes may apply. Paddle processes checkout and subscription payments and may act as merchant of record. You can manage or cancel your subscription through the billing portal.

Cancellation takes effect at the end of the current paid period unless the billing interface states otherwise. Refund requests are handled through Paddle’s processes and any mandatory consumer rights that apply where you live. These Terms do not limit rights that cannot legally be waived.

7. Kivocard intellectual property

Kivocard and its software, interface, branding, and original materials are protected by intellectual-property laws. Except for the limited right to use the service under these Terms, no Kivocard rights are transferred to you.

8. Availability and changes

We may change, suspend, or discontinue features, plans, limits, integrations, or pricing. We will provide reasonable notice when a change materially affects an active paid subscription. The service may occasionally be unavailable for maintenance, security, provider outages, or events outside our control.

9. Suspension, termination, and deletion

You may stop using Kivocard or delete your account at any time. We may suspend or terminate access for a serious or repeated violation, security risk, legal requirement, or nonpayment. Account deletion is permanent and may not remove records that must be retained for billing, fraud prevention, or legal compliance.

10. Disclaimers and limitation of liability

To the extent permitted by law, Kivocard is provided “as is” and “as available” without warranties of uninterrupted operation, perfect accuracy, or fitness for a particular purpose. To the extent permitted by law, Kivocard is not liable for indirect, incidental, special, consequential, or punitive losses. Nothing in these Terms excludes liability or consumer rights that applicable law does not allow us to exclude.

11. Applicable law and disputes

These Terms are interpreted under laws applicable to Kivocard’s operation, while preserving mandatory rights available in your country of residence. Before starting a formal dispute, please contact us so we can try to resolve the issue directly.

12. Changes and contact

We may update these Terms as the service evolves. A new effective date will identify the current version. Continuing to use Kivocard after an update takes effect means you accept the revised Terms where permitted by law.
